Acceptance of Terms

These Terms and Conditions (the “Terms”) are a legal agreement between you and Fixify LLC (“Fixify,” “we,” “us,” or “our”) that governs your access to and use of the Fixify property maintenance management platform at fixifypms.com and app.fixifypms.com, including any related applications, APIs, SMS and voice channels, and other services we provide (together, the “Services”). By creating an account, submitting a maintenance request, receiving SMS messages from us, calling a Fixify phone number, or otherwise using the Services, you agree to these Terms. If you do not agree, do not use the Services.

If you are accepting these Terms on behalf of a company or other organization, you represent that you have authority to bind that organization to these Terms.

The Services

Fixify provides software that helps property managers, landlords, residents, and vendors coordinate maintenance requests end to end, including intake via web, SMS, email, and voice; triage and categorization; vendor dispatch and scheduling; invoice capture; approvals; and, where enabled, payment of vendors. Specific features vary by plan and by the configuration chosen by each property management organization.

Accounts

You must provide accurate information when creating an account and keep it up to date. You are responsible for safeguarding your account credentials and for all activity that occurs under your account. Notify us immediately at support@fixifypms.com if you suspect unauthorized access.

The Services are intended for use by adults. You must be at least 18 years old to create an account.

User Roles

The Services are used by several types of users. Your role determines what you can do in the Services:

  • Property managers and landlords create organizations, manage properties and units, invite residents and vendors, and configure automation and payment settings.
  • Residents submit and track maintenance requests for the units they occupy.
  • Vendors and contractors receive dispatch notifications, accept jobs, update status, submit invoices, and receive payments.

Data entered by one user is visible to the other users in the organization who are involved in a given request, consistent with our Privacy Policy.

Acceptable Use

You agree not to:

  • Use the Services to violate any law or the rights of others.
  • Submit false, misleading, or fraudulent maintenance requests, invoices, or payment instructions.
  • Upload content that is defamatory, harassing, obscene, or otherwise unlawful.
  • Attempt to bypass security, rate limiting, access controls, or usage measurement.
  • Reverse engineer, scrape, or attempt to derive source code from the Services except as permitted by law.
  • Interfere with or disrupt the Services, our infrastructure, or our service providers.
  • Use the Services to send unsolicited marketing messages or to harass any person.

Program description

By opting in, you agree to receive transactional SMS messages from Fixify related to:

  • Maintenance request intake, confirmations, and updates.
  • Appointment scheduling and reminders.
  • Vendor dispatch, job details, and completion confirmation.
  • Account notifications and security alerts.
  • Customer support responses.

Participation is voluntary and is not a condition of any purchase.

Message frequency

Message frequency varies based on maintenance activity. Users can generally expect up to 10 messages per week, although frequency can be higher during active maintenance events.

Message and data rates

Message and data rates may apply depending on your mobile carrier and service plan. Please check with your mobile provider for details.

Opt-in

You opt in by providing your phone number and affirmatively agreeing to receive SMS messages during sign-up in the Fixify application, during resident onboarding in the Fixify resident portal, or during vendor onboarding in the Fixify vendor portal. The consent checkbox is unchecked by default and you must check it to submit the form. By checking the box you confirm that you are the authorized user of the phone number provided.

Opt-out

You may opt out at any time by replying STOP to any SMS message you receive from us. After you send STOP you will receive a single confirmation and no further SMS messages will be sent to that number unless you opt in again.

Carriers

Supported carriers are not liable for delayed or undelivered messages.

Privacy

We do not share mobile opt-in data, phone numbers, or SMS consent information with any third party or affiliate for their marketing or promotional purposes. Use of SMS information is governed by our Privacy Policy.

Voice Calls and AI-Powered Intake

When you call a phone number assigned to an organization in Fixify, your call is routed to an automated voice assistant powered by Fixify and third-party AI providers. Calls may be recorded and transcribed for the purposes of creating and updating maintenance requests, providing customer support, and improving the Services. At the start of each call you will be informed that the call is handled by an automated assistant and may be recorded. If you do not consent to recording, end the call and submit your request through another channel such as SMS, email, or the resident portal.

AI-Assisted Features

The Services use artificial intelligence to classify requests, suggest categories and priorities, analyze photos, and extract information from invoices and messages. AI output is a best effort and may contain errors. Property managers are responsible for reviewing AI suggestions before taking actions that have financial, legal, or safety consequences, including scheduling, dispatching, approving invoices, and releasing payment.

Invoices, Approvals, and Vendor Payments

Where enabled by a property management organization, Fixify supports invoice capture, approval workflows, and payment to vendors through our payment processor (currently Stripe) or through a connected accounting system such as QuickBooks Online. By using these features you agree that:

  • Fixify is not a bank and does not hold funds. Payments are processed by third-party payment providers subject to their own terms.
  • The property management organization, not Fixify, is responsible for verifying that invoices are accurate and that work has been completed before approving payment.
  • Auto-approval and auto-payment settings, if enabled, operate only within the rules configured by the organization, such as maximum amount, preferred vendor status, and photo proof requirements. The organization is responsible for those settings.
  • Vendors must provide accurate tax and payout information and are responsible for their own tax reporting obligations.
  • Chargebacks, disputes, refunds, and reversals are handled according to the payment processor’s rules and the organization’s own agreements with the vendor.

Third-Party Integrations

The Services may connect to third-party services such as QuickBooks Online, Google Calendar, Microsoft Outlook, Stripe, Twilio, and others. Your use of those services is governed by their own terms and privacy policies. Fixify is not responsible for third-party services, and we may stop supporting any integration at any time.

Your Content

You retain ownership of the content you submit to the Services, including maintenance descriptions, photos, videos, documents, invoices, and messages (“Your Content”). You grant Fixify a worldwide, non-exclusive, royalty-free license to host, store, process, display, transmit, and create derivative works of Your Content solely as needed to operate, improve, and provide the Services and as permitted by our Privacy Policy.

You represent that you have all rights necessary to submit Your Content and that it does not violate any law or the rights of any third party.

Fees and Subscriptions

Property management organizations may be charged subscription fees, usage-based fees, or payment processing fees for the Services. Fees, billing frequency, and refund terms are set out in the applicable order form or pricing page at the time of purchase. Fees are non-refundable except as expressly stated or as required by law. You authorize us to charge your designated payment method for all fees owed.

Suspension and Termination

You may stop using the Services at any time. Property management organizations may close their accounts by contacting support. We may suspend or terminate your access to the Services if you violate these Terms, if required by law, or to protect the security or integrity of the Services. On termination, your right to use the Services ends, but sections of these Terms that by their nature should survive (including ownership, disclaimers, limitation of liability, and dispute resolution) will continue in effect.

Disclaimers

THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, FIXIFY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE. FIXIFY DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT AI-GENERATED OUTPUT WILL BE ACCURATE OR COMPLETE.

The Services are not a substitute for professional judgment. For emergencies involving risk to life or property (including gas leaks, active fires, flooding, or sewage backups), call 911 or your local emergency services.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, FIXIFY AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM OR RELATING TO THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. FIXIFY’S TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO FIXIFY FOR THE SERVICES IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS.

Indemnification

You agree to defend, indemnify, and hold harmless Fixify and its affiliates from any claims, damages, liabilities, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your violation of these Terms, your misuse of the Services, or Your Content.

Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Services will be brought in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts. Nothing in this section prevents either party from seeking injunctive relief in any court of competent jurisdiction.

Changes to These Terms

We may update these Terms from time to time. Updates will be posted on this page with a revised effective date. For material changes we will provide additional notice through the Services or by email. Your continued use of the Services after an update constitutes acceptance of the updated Terms.
